我方在此谨通知贵方，_______________________________（以下简称投标人）响应WKZB1822HBN100968号 “投标邀请函”，参加亚行贷款湖北黄冈城市环境综合治理项目80公顷的天然湿地、4片人工湿地工程（合同名称）项目，于2018年10月12日递交其投标。
We have been informed that (hereinafter called “the Bidder”) has submitted to you its bid dated October 12th,2018 (hereinafter called “the Bid”) for the execution of ADB Load Urban Environment Comprehensive Governance Program of Huanggang City, Hubei Province, Natural Wetlands of 80 Hectares, 4 Constructed Wetlands Project under Invitation for Bids No WKZB1822HBN100968 (“the IFB”).
我们知晓，根据贵方的要求，该投标必须随附投标保函。
Furthermore, we understand that, according to your conditions, bids must be supported by a bid guarantee.
经投标人申请，我方中国建设银行股份有限公司深圳深南xx支行（银行名称）在此无条件和不可撤销地保证，在收到贵方书面要求声明投标人违反了下列投标条件规定的义务后，即向你方支付无追索权的（大写）叁佰柒拾万元整（小写）￥3,700,000.00元：
At the request of the Bidder, we China Construction Bank Corporation Shenzhen xx Branch hereby irrevocably undertake to pay you any sum or sums not exceeding in total an amount of (amount in words) RMB three million and seven hundred thousand (amount in figures)￥3,700,000.00 upon receipt by us of your first demand in writing accompanied by a written statement stating that the Bidder is in breach of its obligation(s) under the bid conditions, because the Bidder
- 投标人在其投标函所述的投标有效期内撤回了其投标文件；或
- 不接受根据投标人须知进行修正的错误；
- 投标人在其投标函所述的投标有效期内收到业主发出的中标通知书后，(i)未能或拒绝执行合同协议；或(ii)未能或拒绝按照“投标人须知”的规定提交履约保证金；或(iii)未能或拒绝提交国内优先保证金（如要求）。
(a) has withdrawn its Bid during the period of bid validity specified by the Bidder in the Letter of Bid; or
(b) does not accept the correction of errors in accordance with the Instructions to Bidders (hereinafter “the ITB”); or
(c) having been notified of the acceptance of its Bid by the Employer during the period of bid validity, (i) fails or refuses to execute the Contract Agreement, or (ii) fails or refuses to furnish the performance security, in accordance with the ITB, or (iii) fails or refuses to furnish a domestic preference security, if required.
本保函在出现下列情形之一时失效：
（a）如果该投标人中标，则在我行收到该投标人签署的合同副本和按该投标人旨意而开具给贵方的履约保函副本；
（b）如果该投标人没有中标，则在(i)我行收到贵方发给该投标人关于中标人情况的通知书副本时，或(ii)在该投标人的投标有效期届满28天后，以先到者为准。
（c）本保函的有效期截止至2019年00月00日。
This guarantee will expire (a) if the Bidder is the successful Bidder, upon our receipt of copies of the Contract Agreement signed by the Bidder and the Performance Security issued to you upon the instruction of the Bidder; or (b) if the Bidder is not the successful Bidder, upon the earlier of (i) our receipt of a copy of your notification to the Bidder of the name of the successful Bidder, or (ii) 28 days after the expiration of the Bidder’s bid, or (iii) this guarantee shall remain in force until Month 00th, 2019.
因此，任何根据本保函提出的付款要求都必须在上述日期前送达我行。
Consequently, any demand for payment under this guarantee must be received by us at the office on or before that date.
本保函适用ICC458号见索即付保函统一规则。
This guarantee is subject to the Uniform Rules for Demand Guarantees, ICC Publication No. 458.[Or 758 as applicable.]
本保函以中文版为准。
This warranty is subject to the Chinese version.
